Rental Housing Information   Any User who advertises rental property on Web site retains sole responsibility for compliance with all applicable laws, including fair housing requirements. User warrants that such advertising is for rental housing that is currently available or coming available, and that he/she has full right and authority to advertise the rental and to enter into these Terms of Use.

Web site Owner does not screen or endorse any of the prospective roommates, tenants, or landlords listed on Web site, and does not take any responsibility for the character of posting or viewing party. It is the sole risk and responsibility of User to post contact information on this Web site, to contact other Web site users, and to determine the character and acceptability of any prospective tenant, roommate, or landlord. Web site Owner cannot be held responsible for any events that transpire through use of Web site. Always use the same caution when contacting or meeting other Web site users as you would when contacting or meeting people you do not know.

Fair Housing Notice  All real estate advertising is subject to the Federal Fair Housing Act, which makes it illegal to advertise any preference, limitation or discrimination based on race, color, religion, sex, disability, familial status or national origin or intention to make any such preferences, limitations or discrimination. Gender preference is allowed only for shared housing. Web site Owner will not knowingly accept any advertising for real estate which is in violation of the law. Restrictions on Use of Materials   No material from Web site may be copied, shared, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without the prior written permission of Owner AND posting party. Furthermore, information from Web site may not be used for purposes of solicitation of goods or services, free or otherwise, or for any purpose other than that of a personal nature. Information regarding rental housing may only be used for purposes of locating a rental for personal use.

Any User who violates the above clause is damaging the value of Web site, and agrees to pay Web site Owner $10,000 for each incidence of solicitation or wrongful use.

Limitation of Liability   Under no circumstances, including, but not limited to, negligence, shall Web site Owner be liable for any actual or consequential damages that result from the use of, or the inability to use, the materials in this site. In no event shall Owner's total liability to User for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you, if any, for accessing Web site. Owner cannot guarantee that every client will find housing through use of Web site.

Governing Law, Jurisdiction, and Dispute Resolution  These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of laws principles. User agrees that any and all disputes shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County.
